Terms of Service

These Terms form a binding agreement between you and Aligned Hearts. They apply from the moment you use the site, download the app, create an account, book a session, or buy a ticket.

If you do not agree with them, do not use the service. That is a real option and no hard feelings.

You must be 18 years of age or older to use Aligned Hearts. There are no exceptions and we enforce this.

You also confirm that you: are legally able to enter a contract; have never been convicted of a felony involving violence or a sexual offence; are not required to register as a sex offender in any jurisdiction; and are not barred from using this type of service under any applicable law.

We may terminate any account that breaches this section immediately and without refund.

One account per person. Accounts are personal and non-transferable — you may not sell, share or lend yours.

You are responsible for keeping your credentials secure and for what happens on your account. Tell us at hello@alignedhearts.singles if you think it has been compromised.

You must give accurate information and keep it current. Impersonating someone else, using another person's photographs, or misrepresenting your age, marital status or intentions is a material breach.

Aligned Hearts offers, depending on what you choose:

• The app. A free service delivering introductions matched on the Five Alignments, plus messaging with mutual matches, event tickets, and booking.
• Matchmaking. A retained, six-month professional engagement under a separate written agreement.
• Coaching. Individual and couples sessions.
• Events. Ticketed in-person nights.

Introductions are a professional judgment, not a product specification. We select people we believe are worth your time based on the information available to us. We do not guarantee any number of introductions, any number of dates, any level of interest from another person, or any relationship outcome. Anyone in this industry who guarantees those things is making a promise they cannot keep.

You may not:

• Use Aligned Hearts if you are under 18, or attempt to communicate with anyone you believe to be under 18
• Harass, threaten, stalk, defame or abuse another member
• Solicit money, financial information, cryptocurrency, gift cards or investments from another member, for any reason
• Advertise, recruit, sell anything, or use the service commercially
• Post content that is unlawful, hateful, sexually explicit, violent, or that infringes someone's rights
• Share another member's photographs, messages, profile or identity outside the service without their permission
• Upload someone else's images, or images generated to misrepresent your appearance
• Use bots, scrapers, or automated means to access, copy or collect data from the service
• Reverse engineer, decompile or attempt to derive source code
• Create a new account after being removed

Romance fraud. Attempting to defraud a member is grounds for immediate permanent removal and referral to law enforcement. Where someone is removed for fraud, we may notify members who communicated with them, and you agree that we may do so. We will never ask you for money on another member's behalf.

You keep ownership of everything you upload. You grant Aligned Hearts a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your content solely to operate the service — that is, to show your profile to people you have been matched with and to deliver your messages. This licence ends when you delete the content or your account, except for copies in routine backups purged on our normal cycle.

You confirm you have the right to everything you upload, and that your photographs are of you and are current.

We may remove content that breaches these Terms or our Safety & Community Standards.

Members create their own profiles and messages, and we do not pre-screen everything. You interact with other members at your own risk, and you are responsible for your own decisions about who to meet and where.

Read the Safety & Community Standards page before meeting anyone. It sets out exactly what we do and do not check, and practical safety measures that are worth the two minutes.

Prices are shown before you pay. Payments are processed by Stripe; card details never reach our servers.

In-app purchases, if we ever offer them, are processed by Apple or Google under their terms, and refunds for those are handled by the store rather than by us.

The app is currently free, with no subscription and nothing to purchase inside it. If that changes, we will tell you in advance and any recurring charge will comply with applicable automatic-renewal law — clear disclosure before you pay, affirmative consent, and a cancellation path as easy as the signup.

You are responsible for any applicable taxes.

Three-business-day right to cancel a dating services contract.

This right is required by the dating service laws of California, Illinois, Texas, New York, Ohio and other states. Aligned Hearts applies it to every client in every state. The same statement appears in at least 10-point boldface immediately above the signature line on every matchmaking engagement letter.

Refunds under this section are issued within ten days of our receiving your notice.

All other cancellations — sessions, tickets, retainers after the three-day window — are governed by the Cancellations & Refunds page, which forms part of these Terms.

A ticket admits one named person. Tickets are not transferable except as set out on the Cancellations & Refunds page.

By attending you agree to behave decently toward everyone in the room. Conduct that makes an event unsafe or unpleasant — harassment, aggression, intoxication to the point of disruption — ends your evening and your membership, without refund.

We may photograph or film events. We will not publish any image in which you are identifiable without your separate written consent, and you can tell us at the door that you would rather not be photographed at all.

You can close your account at any time from inside the app or via Delete Your Account. No retention call, no form, no persuasion.

We can suspend or end your account if you breach these Terms or the Safety Standards, if your conduct puts another member at risk, or if we are required to. Where a breach is serious — fraud, threats, anything involving a minor — removal is immediate and permanent, and no refund is given.

If we end your account without cause, we refund the unused portion of anything you have paid.

Sections 6, 12, 13, 14, 15, 16 and 17 survive termination.

The Aligned Hearts name, logo, the Five Alignments framework, the site, the app and all associated content are owned by Aligned Hearts and protected by intellectual property law. You get a limited, personal, revocable, non-transferable licence to use the app for its intended purpose. Nothing else is granted.

If you believe content on Aligned Hearts infringes your copyright, email hello@alignedhearts.singles with "DMCA" in the subject line and include: identification of the work, identification of the infringing material and where it is, your contact details, a statement of good-faith belief that the use is unauthorised, a statement that the notice is accurate and that you are authorised to act, and your signature. We remove infringing material and terminate repeat infringers.

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that you will meet anyone, that any introduction will lead anywhere, that any member is who they claim to be, that the service will be uninterrupted, or that any defect will be corrected.

Some states do not allow certain exclusions, so parts of this section may not apply to you.

To the fullest extent permitted by law, Aligned Hearts and Samuel will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or emotional distress, arising from your use of the service or from your interactions with any other member — whether online or in person.

Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred dollars.

Nothing here limits liability for gross negligence, wilful misconduct, fraud, or anything that cannot be limited by law.

Please read this section. It affects how disputes get resolved.

Talk to us first. Before starting any formal proceeding, email hello@alignedhearts.singles describing the problem and what you want. Most things get resolved here, and we ask for 60 days to try.

Arbitration. If that does not work, you and Aligned Hearts agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration is less formal than court, uses a neutral arbitrator, and the decision is binding.

Class action waiver. Disputes are resolved individually. Neither of us may bring a class, collective or representative action, and the arbitrator may not consolidate claims.

Exceptions. Either of us may bring an individual claim in small claims court, and either may seek injunctive relief in court for intellectual property or unauthorised access.

Where arbitration is unenforceable, disputes go to the state or federal courts in Fulton County, Georgia, and both of us consent to that jurisdiction.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where the consumer protection law of your home state gives you rights that cannot be waived. Those rights stand.

These terms apply to the iOS app:

• This agreement is between you and Aligned Hearts, not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. Apple has no other warranty obligation.
• Aligned Hearts, not Apple, is responsible for product liability claims, claims that the app fails to meet legal requirements, and claims under consumer protection or privacy law.
• Aligned Hearts, not Apple, is responsible for investigating and resolving any third-party intellectual property claim relating to the app.
• You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Use of the Android app is additionally subject to Google Play's Terms of Service.

Changes. We may update these Terms. For material changes we will email account holders and post notice at least seven days before they take effect. Continuing to use the service afterward means you accept them. If you do not, close your account.

Whole agreement. These Terms, the Privacy Policy, the Safety & Community Standards, the Cancellations & Refunds page and, for matchmaking clients, the engagement letter, are the entire agreement. Where an engagement letter conflicts with these Terms, the engagement letter governs for that client.

Severability. If any provision is unenforceable, the rest survives.

No waiver. Not enforcing something once does not waive it.

Assignment. You may not assign these Terms. We may, on notice, to a successor.

Notices. We give notice by email to your account address or by posting on the site. You give notice to hello@alignedhearts.singles.
